The standard: 25% of the commission
25% of the receiving broker's gross commission is the international standard for referring to Mexico. Real example: a $450,000 USD sale at 6% commission yields ~$6,750 USD referral for a single client. It pays at closing.
Do I need a Mexican license? No
As long as you only refer (you don't show property or negotiate inside Mexico), you don't need a Mexican license. The Arizona Association of REALTORS® confirms it: a professional legally operating in Mexico can pay a referral to a licensed broker in your state. The one who must be properly licensed is the receiving broker in Mexico.
How it's documented
- Written referral agreement, broker-to-broker, BEFORE the first contact with the client.
- Specify: fee %, term, which transaction it applies to, and a 'tail' clause (later purchases).
- Register the client in writing (date + source) to anchor procuring cause.
- The fee is paid to the broker of record, not the agent personally.
